Burglars rights

We were just sat in the office talking about getting robbed. If you catch a Burglar in your house do you think its right that they should be given protective rights? I have been burgeled and I know that if I caught the burgler I would have wrapped a Base ball bat round their head. So what do you think? If you can think of any other Answers let me know and I will add them.

Taking the “burglar’s rights” nonsense to its logical conclusion, someone could knock on your door, say “Hello - I’m here do to over your house. I’m coming in to help myself and if you resist me in any way it is assault, and I’ll sue you”. [}:)][}:)][}:)] If you are absolutely certain that someone should not be in your house (And not your housemate coming back form the pub inebriated [xx(]), you should be allowed to eject them with reasonable force and leave the bits on the pavement for the police to pick up.

I think legally you can only meet force with equal force. Therefore if you catch a burglar and attack him/her with a seven iron when you leave him/her unconcious in the hallway ensure you place a spare club in his/her hand, obviously a pithcing wedge would be no good as this is clearly not equal force, but a six iron would be fine - you would probably be considered to have been lenient.

My previous comments should, of course, be taken as purely my own opinion and not as either: a) Legal advice, b) Grounds for defence. [:D] (NB Steven, I guess running him over with a tank is out of the question…?)

Edward - if he/she is drving a tank into your house then clearly it is equal force, otherwise it maybe deemed excessive - its a grey area this law thing, or is it a donkey’s ass I forget.

Here you seem to make a funny thing about everything. Someone broke into my home last December. Lucky or not, I wasn’t at home. It was the Sunday before Xmas. I had to postpone my holidays to got my front door fixed. Burglar rights?? If someone breaks into you home you should have the right to protect yourself and your property. If you go too far there should be an investigation for sure. And what about bank robbers rights? Terrorists rights??

You cannot forget about your rights that are being violated by the worthless bugger trying to remove all your property. I mean, why should we give someone that doesn’t care about our rights, even more rights to protect him so he can rob us then sue us if we try to stop him? Should they be subjected to cruel or unusual punishment. No, but still think I should be free to use necessary force to prevent someone from violating myself, my family or my property.

I must admit I am a bit astonished by this discussion. Judging by your statements, it sounds as if it were illegal in the UK to defend yourself and your property [xx(] Here in .at, you have the legal right to defend yourself, other persons and your property, provided you do not use “excessive force”. Even excessive force may be legal if you can prove that you had been driven by fear, panic, confusion etc. This sounds like a reasonable regulation to me.

xorph, Did you not hear about the Tony Martin case in the uk? He had been robbed on numerous occasion’s and in the end got so feed up with it that he pulled a shot gun out and shot one of the burglars dead. He got jailed for it! The people who were robbing him at the time had travelled 60 odd miles to get to him. To me the bloke deserves a medal not a jail sentence!

This is a classic case of the UK being a stuffed up place! [}:)] The authorities are too worried about the worthless piece of trash that decides to break into someone else’s property and steal (or worse). But hey, it’s expected. This is the same country that open’s their hands to illegal immigrants. What happened last year with that boat full of illegal immigrants trying to get into Australia - their special forces went out and told them to bugger off! [;)] Also in this country, single Mum’s get so many benefit’s if they have 3 or 4 children by different fathers and decide they couldn’t possibly work ever again … and this is when you have other people in this country who work hard and can’t afford a pot to pi$s in!

Nope. This story didn’t seem to make it across the canal and the alps[:p] But now that you tell me about it, this whole discussion makes sense to me. I presume he would have been jailed here just as well, depending on the situation and whether the gun was legally owned or not. If he had been ambushed by a gang of armed, reckless burglars and defended himself with a legal gun, he probably would have got(ten???) away with it. If, OTOH, he had caught a single, weak & unarmed burglar and shot him with an illegal gun, he would most likely have been jailed. The general principle is to use the least amount of force necessary to defend yourself - which is just fair, IMHO. Talking about shooting trash, this quote from Clint Eastwood’s “Unforgiven” comes to my mind: “You ****! You shot an unarmed man!” “He should have armed himself.” [}:)][:D]
