Hello,

We are having a deployment of AX 4.0 in Spain and now we want to have a new deployment in India including the customization done in Spain, but with Regional functionality in India.

Correct me if I am wrong, installing AX new AOS in India with instance in Spain will do the job. Additional GLS Layer files, USR files (*.aod) needed to be copied to new application server.

You are right. For the Indian functionality like taxation, you will have to install the GLS_CONS layer and USR files if you have any customization on the USR layer.
